Client riding motorcycle was hit by a car when the driver of the car pulled out of his driveway without looking. Mr. Walwyn was able to obtain the entire policy limits of $100k after showing the full extent of the fractures and long-term medical consequences of the accident.

Of special note was the complicated surgery for the client requiring internal fixation of the bones in the arm and legs. Because the policy limits of cases are often inadequate to compensate severe injuries, it is important to investigate the extent to which the at-fault driver had any additional resource to help pay for the damages. In this case there were insufficient additional funds beyond the policy limit of the driver’s insurance.

While words cannot describe the horror of the accident and the consequences, Mr. Walwyn was able to deliver some measure of justice to the client and her family. While the details of the agreement cannot be disclosed, it was necessary to provide a clear connection between the driver’s prescription medication as well as the effect of the medication on her driving. After a full review of the evidence presented, the insurance company was forced to tender its entire policy limits.

A truck driver working for a large national chain of department stores failed to notice traffic in front of him was stopped and plowed into the rear of one car causing a chain reaction that eventually included two clients of Mr. Walwyn who were also stopped. The injury caused severe damage to the husband who suffered hip complications requiring extensive therapy.

This case was settled before a jury trial when Mr. Walwyn demonstrated the likelihood of future therapy and additional pain and suffering, especially given the advanced age of the client. The rear of the client’s car was crumpled like a piece of paper, the photos of which would have made for an impressive jury trial exhibit.

A married couple and pilot pilot were killed when a small airplane traveling from Oregon to Ecuador, South America crashed in the side of a mountain in Columbia, S.A., making recovery of the bodies extremely difficult and the recovery of the aircraft impossible.

The couple left a total of eight children in Ecuador, S.A., and several complicated international hurdles. Mr. Walwyn obtained the maximum policy limits of $1M. It was necessary that Mr. Walwyn use his knowledge of the Spanish language to coordinate with the guardians of the children, the local attorneys, in addition to obtaining the necessary documentation from the U.S. Embassy in Quito.

A Mexican national with a work visa fell from a barn loft while working on a farm leaving him a paraplegic from the waist down. The client was unable to care for himself and is bound to a wheel chair for the rest of his life.

Mr. Walwyn coordinated with local counsel in a neighboring jurisdiction to obtain the maximum settlement in addition to money for his wheel chairs, and other future medical expenses in an amount well over $1M. This case was complicated due to the relatively young age of the client (24) and the life expectancy of possibly 50 years or more. Mr. Walwyn needed to make sure that the settlement award would sufficiently cover his expenses and was successful in obtaining that amount.
